What Happens If a Child Refuses Visitation in California?
When a child refuses to visit the other parent, the custodial parent may not know whether to enforce the schedule, respect the child’s wishes, or request a custody modification.
In this video, Binoye Jos of JOS Family Law explains that the answer may depend on several factors, including the child’s age, maturity, intelligence, preferences, and the existing court order. California courts may give greater consideration to an older or sufficiently mature child’s views, but there is no automatic rule allowing the child or parent to cancel visitation.
Parents should continue encouraging appropriate parenting time and consult a family law attorney before withholding visitation. Reintegration or reunification therapy may also be considered when the parent-child relationship has been damaged.
