Cheating Spouse in California: Can the Court Sanction Them?


 When a husband or wife discovers that their spouse is cheating, one of the first questions may be whether the divorce court can punish the unfaithful spouse.

In this video, Binoye Jos of JOS Family Law explains that the affair itself may not automatically lead to sanctions. However, the use of community funds for gifts, travel, accommodation or other affair-related expenses could raise financial concerns during the divorce.

Rather than allowing anger to drive the case, individuals should focus on documenting relevant transactions, protecting their assets and pursuing a practical resolution with experienced legal guidance.
